Terms of service.

Tom Quigley Personal Training aims to provide all clients with the highest level of service possible. In order to do that, certain terms need to be observed and adhered to by the client. Where a client commences a training programme and makes any payment in respect of that programme, they are confirming they have both read and understood, and agree to adhere to, the terms set out below.

GENERAL DATA PROTECTION REGULATION

In accordance with Data Protection laws when a client completes a programme block, Tom Quigley Personal Training will only hold onto their personal data for a period of 4 weeks after the client’s last session, unless they indicate they are going to continue with another block, or request the information to be retained. After this 4 week period the data will be destroyed.

PERSONAL TRAINING SERVICES

If you commence a training programme with Tom Quigley Personal Training you will be asked to complete a PARQ Assessment (Physical Activity Readiness Questionnaire) and consent form to ensure it is safe to exercise. This form is your opportunity to document any illnesses or injuries that may impact or prohibit your ability to undertake exercise.

Clients must come to each training session dressed appropriately, with no loose-fitting jewellery, and must always bring fluids (water, sports drinks) with them in order to stay hydrated throughout.

Should a client experience any pain, discomfort or injury during any of their sessions, they must make the Personal Trainer aware immediately so that they can take the most appropriate action. Where a client’s health changes during the course of their programme block, they must check with their health care provider to ensure that it is safe to continue.

Please note that despite the many significant health benefits that exercise provides, no exercise programme comes without natural risks, and although the Personal Trainer will do their utmost to provide safe instruction and guidance, they cannot guarantee a client’s personal safety at all times. In embarking on a programme with Tom Quigley Personal Training the client accepts that exercise comes with possible risks and that if they are unsure about any underlying medical or health conditions they will confirm with their healthcare provider beforehand.

Exercise sessions can be strenuous and must be scaled and undertaken in moderation. Providing ongoing feedback to the Personal Trainer is essential in order for them to be able to make adaptations or progressions to suit each client. In particular, clients must voice promptly any unusual pains, feelings or medical related issues, or conditions such as dizziness, nausea, chest discomfort or difficulty breathing during exercise.

NUTRITIONAL GUIDANCE

Personal Trainers are not qualified to provide diet sheets to clients. They are, however, qualified to provide packages providing nutritional guidance on fuelling the body in order to achieve specific fitness or physical goals, and to achieve optimal health throughout the programmes. This guidance and related information concerns health factors that are within a client’s control; diet, nutrition and lifestyle. Clients may be asked to discuss their relationship with food, and to disclose any allergies, or food intolerances, or any restrictions as a result of underlying medical conditions. It is not the job of the Personal Trainer to make any diagnoses, but they may be able to refer you to specialists who can provide expert guidance on conditions such as eating disorders, Crohn’s disease, Celiac disease and Diabetes.

CANCELLATIONS

Workout sessions are planned for each client individually ideally weekly in advance and therefore some considerable time and effort has already been put in before a client arrives for their workout. In such cases where a client needs to cancel their session within 24hrs of their scheduled workout, they may forfeit that session. This is subject to our discretion.

If Tom Quigley Personal Training needs to cancel a session for any reason within 12 hrs or less of a scheduled workout, the Personal Trainer will provide the client with an alternative day and time within a seven day period, or carry forward the session further into the workout block. If the client wishes, they can be provided with a gym or home workout plan if they still wish to workout at that time.

Dual and Group PT sessions follow the same terms; if you train as a pair and one half cancels, the other person must still show up for their session, or they may also forfeit that session. In purchasing any programme, all participants are agreeing their understanding of, and adherence to, the Cancellation terms.

REFUNDS

If, due to medical reasons, you are unable to continue with personal training previously paid for, you may defer the sessions until you are well enough to resume, or you may request a refund of any unused sessions upon submission of a letter from a doctor.

Block sessions should be completed within a specific timeframe (which will be provided by your Personal Trainer), however, if you are unable to complete your sessions within this timeframe please note that no refunds will be given for those sessions not taken. It is the client’s responsibility to ensure they complete their sessions within the required timeframe - please be aware that if you do not follow the programme consistently and within the specified timeframe you will not obtain maximum benefit from your programme. Please also note that refunds can take up to 30 days to process.

CLIENT OBLIGATIONS

  • I understand that Personal Training services are not a substitute for medical care.

  • I understand that Tom Quigley Personal Training is not a medical physician or dietician and does not dispense medical advice, nor will they diagnose or treat any medical condition.

  • I understand that any notes that may be taken will be destroyed after I complete my course unless I ask for them to be kept.

  • I understand that it is my responsibility to make Tom Quigley Personal Training aware of any underlying conditions that may impact my ability to undertake exercise, either before I commence any programme, or as soon as a problem or condition occurs.

  • I will not hold Tom Quigley Personal Training responsible for any complications that may arise from my failure to comply with the above.

  • I understand that Tom Quigley Personal Training cannot provide a refund after payment, nor can I choose mid-course to cancel my course duration. I can only receive a refund if a medical note is presented.

  • I understand that if I need to cancel a scheduled workout session, this needs to be done with no less than 24hrs notice or I may forfeit that session.

  • I understand that I am responsible for carrying out the advice I am given and that I am ultimately accountable for achieving my fitness goals.

  • I agree to hold Tom Quigley Personal Training harmless for claims or damages in connection with our work together.

  • This is contract between myself (the client) and Tom Quigley Personal Training (the service provider) and I understand that is also a release of potential liability. Tom Quigley Personal Training cannot be held responsible for any medical conditions that arise during or after I complete my programmes, and that this is why it is important that I provide all necessary and pertinent information regarding my health and fitness at the very start of the process.
